PRIVATE DISABILITY INSURANCE DENIAL CASES
Knowing that the Social Security disability process often takes so long, it is prudent to
think about purchasing short-term and long-term disability insurance. In fact, your
employer may provide such a benefit.
On the whole, private disability insurance is, we think, a nice benefit to have since
Social Security disability has a five month waiting period and often takes so long to
receive benefits due to the frequent denials and appeals process. Usually it is easier to
work with private disability insurers. Most people receive such benefits long before
Social Security disability.
Unfortunately, many insurance companies have not acted very honorably in paying
claims and have taken advantage of a body of law called "ERISA." Usually ERISA
applies if you have received disability insurance through your employer.
Many times disability insurance companies have made it their business to systematically
deny individuals' claims or terminate their benefits. Certain companies within the
industry are notoriously bad in their practices. That being said there are several
companies out there that we believe are suitable to work with.
If you think you have been wrongfully denied disability benefits we recommend that you
seek out an attorney to learn what options are available. There are often procedural or
administrative steps that you must complete before you can bring a suit against your
insurer.
Do you have a case?
You may ask, "How do I know if I have a case?" More than likely, if you can't perform
your job at work due to your disability and your doctor agrees, then your case shouldn't
be denied. Perhaps just the "sniff test" is all you need. If something smells fishy, then
you should check things out.
